Terms of Service

1. Acceptance of Terms

By accessing or using the AI Crane Monitor platform ("Service"), operated by Think360 Ltd ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

AI Crane Monitor is a cloud-based IoT monitoring platform for crane and heavy lifting equipment. The Service provides real-time data collection, performance analytics, alarm management, predictive maintenance insights, and operational reporting. Access is provided on a subscription basis to registered organisations.

3. User Accounts

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials and API keys.
  • Each user account is personal and must not be shared. Organisation administrators may create accounts for team members.
  • You must promptly notify us of any unauthorised use of your account.

4. Subscriptions & Payment

  • New organisations receive a 14-day free trial. After the trial period, a paid subscription is required for continued access.
  • Subscription fees are billed per crane per month or annually, depending on your chosen plan.
  • All prices are in GBP (£) and exclude VAT where applicable.
  • Payments are processed securely via Stripe. Invoice/PO payment is available for Enterprise plans.
  • We reserve the right to adjust pricing with 30 days' written notice.

5. Acceptable Use

You agree not to:
  • Use the Service for any unlawful purpose or in violation of any applicable regulations.
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Transmit malicious code, excessive automated requests, or data intended to disrupt the Service.
  • Resell or redistribute access to the Service without written consent.

6. Data Ownership & Licence

  • You retain ownership of all data you submit to the Service ("Your Data").
  • You grant us a limited licence to process, store, and display Your Data solely for providing the Service.
  • We may use anonymised, aggregated data for platform improvements and industry benchmarking.
  • Upon termination, you may request export of Your Data within 30 days.

7. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. We are not liable for outages caused by factors beyond our reasonable control, including internet connectivity, IoT device failures, or third-party service disruptions.

8. Limitation of Liability

To the maximum extent permitted by law, Think360 Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim. The Service provides monitoring data and AI-generated insights for informational purposes only and does not replace professional engineering judgement or safety protocols.

9. Termination

Either party may terminate the subscription with 30 days' written notice. We may suspend or terminate access immediately for breach of these Terms. Upon termination, your access to the Service will cease and data will be retained for 30 days before deletion.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notification at least 14 days before taking effect. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
